Terms and Conditions — Tennis Set&Play

1. About us

The Tennis Set&Play mobile application (“App”) is operated by FunPoint Sports, registered in Bulgaria (“we”, “us”, “our”).

These Terms govern your use of the App. By creating an account or using the App, you agree to these Terms.

2. What the App does (and does not do)

The App helps users organize and participate in real-world tennis events (leagues, tournaments, matches). It allows users to:

• Create and manage leagues and tournaments
• Join events and pay related fees
• View schedules, draws and results

3. Eligibility

You may use the App only if:

• You are 13 years or older; and
• You have the legal capacity to enter into a contract in your country of residence.

The App is not intended for children under 13.

4. Your account

You are responsible for:

• Keeping your login details secure
• All activity under your account
• Ensuring your profile details are accurate and up to date

We may suspend or close accounts in case of abuse, fraud, spam, harassment, or a serious breach of these Terms.

5. Payments, wallet balance (Credits), and fees

5.1 Wallet top-ups (Credits)

The App allows you to purchase an in-app wallet balance (“Credits”) using Stripe. Credits are used only to pay for participation in real-world events (tournaments, leagues, registrations) inside the App.

Credits:

• Have no cash value
• Cannot be exchanged, traded, sold, or transferred to other users
• Cannot be used outside the App
• Cannot be withdrawn as cash or paid out to a bank account

Top-ups may be limited to small amounts (for example €5–€25) to prevent misuse and to support the App’s use for event participation rather than as a general payment service.

Payment processing: We do not store full card details. Card data is processed by Stripe.

5.2 Tournament and league fees

Some actions in the App require fees, for example:

• Tournament entry fees for players
• League creation, tournament creation, and organizer fees (where applicable)

In the normal flow, these fees are paid using your Credits.

Automatic wallet refunds (app logic):

• If you are waitlisted and never move into the main list when registration closes, the entry fee is automatically refunded to your wallet.
• If you withdraw from an event while the tournament is still in registration status, the fee is automatically refunded to your wallet.

Outside of these automatic cases:

• Entry fees and organizer fees are generally non-refundable once an event or league has been created and setup work has begun.
• Refunds are not paid out as cash and are not sent to other users.

If you believe you were charged in error, contact us at funpointsports@gmail.com. We may, at our sole discretion, offer a goodwill refund or partial refund. This is not a guaranteed right.

6. Refunds summary

• Tournament and league fees are not refundable in cash.
• In specific cases (withdrawals during registration, or remaining on the waitlist when registration closes), the fee is automatically returned to your in-app wallet.
• Refunds of wallet top-ups, when granted, are processed back to the original payment method where technically possible.
• Nothing in these Terms limits any mandatory consumer rights you have under applicable law.

7. Player contact and phone number visibility

To help players arrange matches, the App may display a player’s phone number to their match opponents. Opponents may contact each other by calling/SMS or via external messaging apps (for example WhatsApp) outside the App. The App does not provide in-app chat or voice calling.

You agree to use opponent contact details only for match coordination and not for spam, harassment, or any unrelated purpose.

8. Behaviour and acceptable use

You agree not to:

• Harass, threaten, or abuse other users
• Spam other users or misuse phone number visibility
• Cheat, commit fraud, or attempt to bypass fees
• Upload or use offensive, illegal, or infringing content (including in names/nicknames)

We may remove content or restrict accounts where we reasonably believe there is abuse, fraud, or a breach of these Terms or the law.

9. Availability and liability

We aim to keep the App available and accurate, but we cannot guarantee it will always be uninterrupted, timely, secure, or error-free.

To the extent permitted by law:

• We are not liable for indirect or consequential losses (such as loss of profits, loss of opportunity, or loss of data) arising from your use of the App.
• Our total liability for any claim relating to the App is limited to the total fees you paid through the App in the 12 months before the claim.

This does not exclude or limit liability that cannot be excluded under applicable law.

Data retention

We may delete or anonymize inactive accounts and inactive content (such as leagues, tournaments, and related rankings) after more than 12 months of inactivity, as described in our Privacy Policy. Payment and transaction records may be retained or securely archived where required for legal, tax, accounting, security, or fraud-prevention purposes.

10. Changes and termination

We may update the App and these Terms from time to time. If we make important changes, we will notify you in the App or by email where reasonably possible. Continued use after changes take effect means you accept the updated Terms.

You may stop using the App and request account deletion at any time. We may suspend or close your account if you seriously breach these Terms or if we are required to do so by law.

11. Governing law

These Terms are governed by Bulgarian law.

Disputes will be subject to the non-exclusive jurisdiction of the Bulgarian courts, without prejudice to any mandatory consumer protections in your country of residence.
